The Regulator has absolute power

No, this is not a real headline.

But it should be.

Because this is the core of the problem we have in Switzerland with financial markets regulation.

This is a real headline in the United States.

The U.S. has a functional regulatory framework with proper checks, balances and effective recourse in cases of Regulator bad behavior.

Switzerland has a dysfunctional regulatory framework, with no proper oversight, no proper checks and balances and zero recourse when the Regulator behaves badly.

In amazingly short (Regulator) time, the SEC admitted just three weeks later that „… it made inaccurate statements…“.

In Switzerland, unimaginable. Inconceivable. Impossible. Right?

This goes to the core of the fundamental problem we have in Switzerland: the Regulator has absolute power.

It is not that the Regulator has too much power, it has absolute power. An absolute No-Go. There are simply no effective checks or balances on FINMAs power.

Regardless of how badly FINMA behaves, what it gets wrong, if it lies, how much destruction it causes, it is answerable to No One.

In the United States, the SEC is subject to a large extent to the court system, the judiciary. Where it can be challenged if it behaves badly. Or lies.

Misrepresentation is just a seven dollar word used by lawyers for a five cent act, lying. In Switzerland, if the Regulator lies, to anyone, there is no one to call it out.

There is no penalty. There is nothing to be done.

In the U.S., it can be sanctioned (monetary fines). You can fact-check the SEC and other regulators (yes, there are more than just one) under the U.S. Freedom of Information Act.

In Switzerland, independent fact checking is effectively impossible largely because Swiss Parliament specifically excluded FINMA being subject to public disclosure by excluding FINMA from the Swiss Freedom of Information Act (Bundesgesetz über das Öffentlichkeitsprinzip der Verwaltung, Art. 2, para 2.).

Excluding the Regulator from transparency obligations guarantees bad behaviour. Repeat, GUARANTEES it.

It gives free license to misbehave without fear of public accountability and places substantial (insurmountable) obstacles to judiciary or executive accountability.

We even have an example. Again, the United States.

The Dodd Frank Act of July 2010 included a provision that excluded the SEC from requests under the Freedom of Information Act.

Using much the same justifications that FINMA use to defend its exclusion. This was repealed only two months later, in September 2010, when it became blatantly obvious to pretty much everyone in both parties what an incredibly stupid idea it is to shield the Regulator from disclosure requirements.

A basic fundamental completely ignored by whoever drafted FINMASA and the Öffentlichkeitsgesetz.

This is the core problem at the heart of the financial services industry in Switzerland. The Financial Market Supervision Act, FINMASA, is an Act of insanity. Pure.

Under „Independence and Supervision“, Art. 21:

Para 3. „It deals with the Federal Council via the FDF“.

Para 4. „The National Council and the Council of States are responsible for its superintendence.“

This in practice means zero oversight or supervision.

Either from the FDF (run by an ex-schoolteacher), the Nationalrat, the Ständerat or the Bundesrat, who collectively or individually barely even pretend to take an oversight role.

There is zero interest, zero benefit in challenging or tangling with the FINMA.

The result: a demonstrably unaccountable, unfit for purpose market regulator, subject to zero oversight or control.

With no penalties for lying or bad behaviour.

The fundamental problem and major threat we have in financial services in Switzerland at the moment is not with the banks or the financial sector.

It is an out-of-control market regulator, lacking the competence, expertise and knowledge to do its job, with absolute power and right now, very, very, very sensitive to criticism.

The situation is hugely destructive to Switzerland, because of the size and importance of the financial sector in the economy.

It is a big issue. FINMASA, the entire construct, needs to be repealed and rewritten. Bern, we have a Problem.

    Dass sich der Author jetzt daran stört, dass ihm die FINMA anscheinend zu stark auf den Füssen steht, lässt mich Böses vermuten.

    • Bist bestimmt ein hoffnungslos überbezahlter Schweizer Bank-Backoffice-Gnom. Nie was gelernt ausser mal die Sek A gemacht und dann seit 20 oder 30 Jahren dabei. Und deshalb der Ansicht „so viel Erfahrung“ zu haben dass Du unkündbar bist?

  12. Disagree – all big regulatory failures happened in the US. Anyone who has analyzed the US regulatory system in detail knows that it is ineffective and the exact opposite of best practice. Its complete failure became evident during GFC and again last year with SVB and other banks.

    FINMA‘s weaknesses are the result of the Swiss political system. The current framework has been imposed by the parliament instructed by the financial services lobby. FINMA – from a global perspective – is actually a better regulator than most peers (based on personal experience with PRA, SEC, BAFIN, BMA, SMA etc)

  17. These are absolutely my words and which I absolutely agree! We think we are the best in everything but we don’t like when other can criticize or correct our behaviors. This is FINMA. They are under the Governments eyes, but no one can really judge or supervise their doing or not doing. Even after the whole CS debacle, we still do not want to learn or improve of the massive mistakes done by every single department involved. For me an absolute false syllogism.
    Especially in the financial system where more and more the massive grievance of the Swiss policy comes to the surface. Covered in innocence, the confidence is shrinking and we lose more and more in the international comparison. Wake up, Switzerland!

  18. Darum ist Dubai auch der sichere Finanzplatz. Strikt reguliert. Da hinkt die Schweiz mittlerweile massiv hinterher. Die Investoren flüchten deshalb auch in Massen in die Emirate und auch Finanz- und Bankinstitute schätzen diese Spielregeln.

    Agreed, Finma has zero oversight or supervision.

    In the US they may have the requested properties but they do nothing as they protect the interests of the US banks. They accused Switzerland for their (former) off-shore business but they still protect the US off-shore business in their own country.

  21. Lieber Herr Hässig, haben sie heute morgen mal in den Spiegel geschaut nachdem sie diesen Artikel veröffentlicht haben? Wenn ja, dann haben sie wahrscheinlich so laut gelacht das sich sämtliche Nachtbaren im Umkreis von 1 km beschwert haben.
    Unsere zahnlose FINMA soll absolute Power haben? FINMA darf nicht mal Busen verteilen, hat einen so niedrigen Budget das es sich nur ahnungslose MA leisten kann. Und genau diese Organisation soll in der Schweiz absolute Macht haben?
    Falls dies so wäre, dann wäre der Schweiz vielleicht das Credit Suisse Drama erspart geblieben. Denn dann hätte vielleicht ein kompetenter Regulator den Laden aufgeräumt bevor er uns allen um die Ohren geflogen ist und jetzt tausende MA ihren Job verlieren.

    • @panama jack: Sie meinen so wie es Ihnen ein tägliches Anliegen zu sein scheint, den ganzen Lesern hier zu zeigen, was für ein freier, vermögender, unabhängiger und sowieso super-Hirsch Sie sind?

      Um glaubwürdig zu sein, wäre eine etwas entspanntere, relaxtere und souveränere Art hilfreich. Sie sind definitiv zu verkrampft und zu gierig nach Anerkennung.
